Cuba Implements Major 2026 Foreign-Investment Reforms
Status: IN FORCE — IMPLEMENTATION DEVELOPING
- What changed
- Cuba has continued implementing reforms intended to facilitate foreign investment and increase flexibility for approved investment projects. The September 2026 reforms include measures affecting investment procedures, employment arrangements, banking, tourism activities and commercial projects. Relevant developments include: simplified procedures in certain foreign-investment processes; increased flexibility for approved investment structures; changes affecting employment arrangements; greater flexibility concerning certain foreign banking arrangements; new opportunities connected to tourism services; private travel-agency activity within the new regulatory framework; independent tour-guide activity within the applicable licensing framework; and broader investment opportunities in tourism, commercial activity and selected real-estate structures.
- Who it affects
- Foreign investors, Cuban companies, MIPYMEs, project developers and international business partners.
- What it means in practice
- Not all foreign investment is automatically permitted. Buying residential property is a separate question: the new Housing Law 187/2026 expressly refers to purchases by foreign natural and legal persons (Articles 43.2 and 89), but it does not create a general right for every foreigner to buy any home, and the practical channels have yet to be confirmed. All investment remains subject to the applicable Cuban authorization, licensing, corporate and sector-specific framework.
- CPS note
- Not all announced reforms are automatically operational. A distinction must be made between existing regulations, changes already published and further reforms that still have to be introduced.
