Cuba’s New Migration and Foreigners Framework Approaches November Implementation

Status: PUBLISHED — IMPLEMENTATION APPROACHING
What changed
Cuba published its new migration, foreigners and citizenship legal framework on 5 May 2026. The legislation establishes an implementation period of 180 days after publication, meaning that the transition toward the new framework is now approaching in November 2026. The new framework reorganizes several migration and residency categories and establishes new legal mechanisms affecting foreigners and Cubans residing abroad.
Who it affects
Foreign residents in Cuba · People planning residency in Cuba · Foreign investors · Property owners and qualifying tenants · Cubans residing abroad · Business owners and investors with activities in Cuba
What it means in practice
This is particularly relevant for foreigners, permanent and temporary residents, Cubans living abroad, investors and people considering longer-term residence in Cuba.
CPS note
The publication of a law and its practical administrative implementation are not always the same thing. Cuba Property Solutions will continue distinguishing between legislation that has been published, legislation that has formally entered into force, implementing regulations, and procedures that are actually being applied by Cuban authorities. Not every provision is already operational.

Real Estate Residency: What Cuba’s New “Residente de Inmobiliaria” Category Means

Status: PUBLISHED — IMPLEMENTATION DEVELOPING
What changed
Cuba’s new foreigners framework explicitly recognizes a migration category referred to as “residente de inmobiliaria”. This creates a clearer legal connection between certain authorized real-estate arrangements and residency for foreigners.
Who it affects
International buyers · Investors · Long-term residents
What it means in practice
For international buyers, investors and long-term residents, property structure and immigration status may increasingly need to be evaluated together rather than as completely separate matters. Important: this category does not remove the existing legal restrictions governing foreign ownership of Cuban residential property and does not mean that foreigners can freely purchase ordinary Cuban residential property. It applies within legally authorized real-estate structures and qualifying ownership or rental situations.
CPS note
Before acquiring, leasing or investing in Cuban property, the legal status of the property and the eligibility of the proposed ownership or rental structure should be verified independently.

Status: PUBLISHED — IMPLEMENTATION DEVELOPING
What changed
The 2026 legal reforms create a specific investor and business migration framework relevant to Cubans who reside abroad and participate in economic activities or investment in Cuba.
Who it affects
Cubans living abroad · Diaspora investors · Participants in Cuban private companies
What it means in practice
This may provide a clearer legal framework for members of the Cuban diaspora who want to participate in Cuban companies, invest in businesses, maintain economic activities in Cuba, participate in private-sector projects, or structure a longer-term business presence in the country.
CPS note
Eligibility and implementation should be verified case by case.
