Cuba Property Laws for Buyers and Investors

A careful, source-led explanation of eligibility, ownership, registry, transactions and investment structures in Cuba.

Cuba property law cannot be reduced to a simple statement that foreigners can or cannot buy. Nationality, migration status, the property's legal category, the intended use and the transaction or investment structure all matter.

Can foreigners buy property in Cuba?

Not through one unrestricted route that applies to everyone. Foreign permanent residents may have different possibilities from non-residents. Certain designated real-estate or approved investment structures may follow separate rules. A case-specific review is required before commitment.

Residential purchase and foreign investment are different

A private residential transaction is not the same as a project governed by Cuba's foreign-investment framework. Law 118/2014 and Decree 325/2014 establish the general foreign-investment framework, but they do not make every property available to every foreign buyer.

Registry and transaction checks

  • Identity and legal capacity of the seller
  • Ownership title and Property Registry entry
  • Co-owners, spouses, heirs and occupants
  • Charges, restrictions and rights of use
  • Description, boundaries and physical reality
  • Legality of extensions or alterations
  • Required notarial, tax and registration steps

2026 housing-law developments

Cuba has announced and published a new housing-law framework in 2026. CPS does not state that this automatically creates mortgages, preserves every emigrant's ownership, or opens general foreign ownership. Detailed consequences should be confirmed from the enacted text, implementing rules and current administrative practice.

Professional and official roles

CPS coordinates information, document gathering and professional review. Notaries, the Property Registry, authorized legal professionals and competent authorities perform the formal acts and make official decisions.
