New U.S. Financial Restrictions Affect Cuba’s Private Sector

Status: ACTIVE / CHANGING ENVIRONMENT
What changed
The United States has withdrawn or restricted certain banking permissions that were previously available to eligible Cuban independent private-sector entrepreneurs. The changes also affect U-turn transactions and U.S. dollar clearing through the U.S. financial system, and expand restrictions on direct and indirect financial transactions involving entities on the Cuba Restricted List. Cuban MiPyMEs and private entrepreneurs have not generally been prohibited from conducting international business.
Who it affects
Cuban MiPyMEs and private entrepreneurs · Foreign businesses trading with Cuban private companies · Foreign investors · Importers and exporters · Banks and payment providers handling Cuba-related transactions
What it means in practice
Import and export with countries such as China, Mexico, European countries and other non-U.S. markets remains possible, subject to applicable Cuban law, banking arrangements, sanctions and compliance. The practical difficulty lies primarily in payments, correspondent banking, compliance and the willingness of foreign banks to process Cuba-related transactions. This is not a total blockade of Cuba’s private sector.
CPS note
Foreign investors and businesses working with Cuban private companies need stronger due diligence regarding banks, payment routes, business partners and potentially restricted Cuban entities. Professional legal and compliance review is recommended.
